The Supreme Court has dismissed an application by former Ghana Infrastructure Investment Fund (GIIF) Chief Executive Officer Solomon Asamoah seeking to overturn a High Court decision compelling him to open his defence in the alleged $2 million Sky Train financial loss case.
Solomon Asamoah and former GIIF Board Chairman Prof. Ameyaw Akumfi are standing trial over allegations that funds were released for the proposed project without the necessary board approval and despite no work having been done to justify the expenditure.
After prosecutors concluded their case, the two accused persons filed submissions of no case, arguing that the evidence presented was insufficient to require them to defend themselves.
However, the High Court, presided over by Justice Kocuvie-Tay, rejected the application and directed them to open their defence.
Mr Asamoah subsequently approached the Supreme Court, arguing that the trial judge had exceeded her jurisdiction by making certain definitive statements, including one suggesting he was responsible for the alleged financial loss.
A five-member panel chaired by Justice Gabriel Scott Pwamang dismissed his application, ruling that the grounds presented did not justify the exercise of the court’s supervisory jurisdiction.
The decision leaves the High Court ruling intact and clears the way for proceedings to continue.
The dismissal means Mr Asamoah must proceed with his defence in the ongoing case. The allegations against him and Prof. Akumfi remain subject to determination by the trial court.
