Suspended Assin Central NDC Secretary threatens to sue party

Sadique Broni Yeboah, the suspended Assin Central Constituency Secretary of the National Democratic Congress (NDC) in the Central Region, has threatened to sue the party.

In a letter to the party leadership, Mr Yeboah’s lawyers asked the party to rescind his suspension within three days.

The lawyers also requested the NDC leadership to grant Mr Yeboah a fair hearing.

They argued that suspending him without a fair hearing was against natural justice.

“This is a clear contravention of due process envisaged under Articles 48 and 49 of the party’s Constitution and same infringes on the principles of natural justice to wit: audi alteram partem (hear both sides). To this extent, your decision is a complete nullity and void ab initio.

“We have the instructions of our client to demand from you the withdrawal of his suspension forthwith within 3 days and give him a fair hearing if you find it meet so to do,” the letter said.

It added: “We have received strict and unqualified instructions from our client to take legal action against you in the event that you default in that regard”.

The party suspended the secretary and the Central Regional Chairman of NDC for a month over anti-party conduct.

This followed the withdrawal of Nurein Shiabu Migyimah from his position as the party’s Assin Central parliamentary candidate over alleged immoral acts and anti-party conduct.

His alleged immoral behaviour included accusations of impregnating the wife of the constituency secretary.

However, the NDC General Secretary, Fifi Kwetey, after a meeting in Accra, said the letter that announced Mr Migyimah’s withdrawal is null and void.

The NDC leadership subsequently suspended the central regional chairman and constituency secretary regarding the letter, citing concerns that it violated due process.

“The letter originating from the Secretariat of the Central Region NDC purporting to withdraw the candidacy of the said Assin Central candidate, Comrade Migyimah, and further suspending his membership of the party, is null and void and stands withdrawn,” Mr Kwetey declared.
