Election 2024: Cudjoe’s lawyers run to EC over petition to bar her candidacy

The legal team for the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, Joana Gyan Cudjoe, has appealed to the Electoral Commission (EC) in response to a petition aiming to bar her candidacy in the upcoming election.

Her legal representatives, Ayine and Associates, in a letter dated October 15, 2024, and addressed to the EC, emphasized that their client remains the duly elected NDC candidate for the December 7 election.

“We write as legal counsel for the National Democratic Congress (NDC) and Joana Gyan Cudjoe, the NDC Parliamentary Candidate for the Amenfi Central Constituency in the 2024 Parliamentary Elections (referred to hereafter as ‘our clients’), and on their instructions to address the matter above,” the letter emphasised.

The letter further highlighted that Ms Gyan was made aware of a petition dated September 13, 2024, and a follow-up letter on September 24, 2024, which was served to the EC.

In the petition, the claimants allege the existence of an interlocutory injunction barring Joana Gyan Cudjoe from presenting herself as the NDC’s parliamentary candidate for Amenfi Central.

The injunction filed at the High Court in Sekondi is to restrict both the NDC and the EC from recognizing or granting Joana Cudjoe any rights or privileges in this capacity.

“The instruction of our clients is that they have become aware of an alleged petition dated September 13, 2024, and a subsequent letter dated September 24, 2024, served on your office wherein the petitioners claim that there is a purported pending order of interlocutory injunction restraining Joana Gyan Cudjoe from holding herself out as the duly elected NDC Parliamentary Candidate for the Amenfi Central Consistency in the Western Region, and also restraining both the NDC and the Electoral Commission, their agents and officers from holding out, allowing Joana Gyan Cudjoe to be held out, dealt with in any way, recognized or afforded any rights or privileges as the duly elected NDC Parliamentary Candidate for the Amenfi Central Constituency,” the letter added.

Meanwhile, the incumbent Member of Parliament for the constituency, Peter Yaw Kwakye-Ackah, has announced his intention to contest as an independent candidate in the 2024 general election, citing unfair treatment from the leadership of the NDC.
