An Accra High Court has struck out the assault case against the Ghana Police Service.
The plaintiffs, who were the organizers of the ‘OccupyJulorbiHouse’ protest in September 2023, argued that the police aggressively apprehended protestors who had massed up to exercise their constitutionally guaranteed right to protest.
According to them, some protestors were forcibly transported to the Regional Police Headquarters in Accra, where they faced further assaults and unjustified detention.
The arrests, they say, undermine the principles of justice and accountability in governance.
They further contend that the treatment they were subjected to, violates their fundamental rights of assembly and expression.
However, on Tuesday, April 9, the High Court struck out the case for want of prosecution.
In other words, the case was struck out because the plaintiff or the defendants failed to pursue or prosecute the case actively.
This could happen due to the plaintiff’s failure to file necessary documents or a lack of progress in advancing the case.
But plaintiff usually has the option to re-file the case.
Meanwhile, both parties were absent when the case was called on Tuesday.
