Accra Circuit Court strikes out case against businessman Alhaji Siba Yahaya

A Circuit Court judge has discharged two accused individuals and struck out a criminal case after prosecutors from the Office of the Attorney General failed to appear in court for the third consecutive time.

The case heard before Her Honour Lawrencia Awura Abena Darkowaa Gyamfi, involved accused persons Alhaji Siba Yahaya and Samuel Asante, who remains at large.

According to court records from the session on April 30, 2025, the initial absence of a substantive prosecutor prompted a brief stand-down.

When the case was recalled, Chief Inspector Eric Pobee, holding brief for the Republic, informed the court, “My lady, whatever transpired in Court at the last Court date, I have informed my Jupol. He said he had also informed the Office of the Attorney General that the Court was ready for the matter to be prosecuted but he had also not heard from them.”

The prosecution confirmed the case docket had been sent to the Attorney General’s office on March 19, 2024.

The presiding judge noted this was the third such occurrence since she assumed her role. “On all three occasions, no attorney from the Office of the Attorney General has appeared to prosecute the matter. To my mind, the Office of the Attorney General is not prepared to prosecute the matter,” stated Judge Gyamfi in her ruling.

Consequently, she ordered, “Therefore, this matter is struck out for want of prosecution. The accused persons are discharged.”
