The Supreme Court has upheld an earlier decision to expunge the Assin North MP James Gyakye Quayson’s name from Parliament’s records.
It will be recalled that the apex court on May 17, directed Parliament to remove Mr Quayson’s name from its records as the Member of Parliament (MP) for Assin North.
The earlier panel ruled that the embattled Assin North MP was not qualified at the time of nomination for the Assin North parliamentary elections in 2020.
It further held that the action by the Electoral Commission (EC) to allow Mr. Quayson to contest when he had not shown his certificate of renunciation was unconstitutional, null, and void, and of no effect.
Mr. Quayson’s name was subsequently removed from Parliament’s records.
Unhappy with the ruling, the embattled Assin North MP filed for a review of the apex court’s decision.
But a nine-member panel unanimously dismissed the review application filed by the embattled MP seeking to overrule the decision by the apex court.
The court held that its decision was lawful and the application was totally unmeritorious.
The Chief Justice, Justice Gertrude Torkornoo, explained that most of the grounds raised by Mr. Quayson’s legal team were a rehash of the arguments raised in the original case.
They, therefore, did not find any exceptional circumstance for the apex court to exercise its review jurisdiction in favor of the MP.
Mr. Gyakye Quayson was reelected in the June 2023 by-election and has been sworn in as the latest member of the legislative house. However, his worries are not over as he is yet to disentangle himself from legal clutches.
