The Supreme Court has indefinitely adjourned the NPP’s case seeking to overturn the injunction on the Akwatia constituency seat issued by the Koforidua High Court.
On December 31, 2024, Henry Boakye Yiadom, the National Democratic Congress (NDC) parliamentary candidate for Akwatia, filed an election petition at the Koforidua High Court.
He sought an ex-Parte interim injunction to prevent Ernest Kumi of the NPP from being sworn in as the Member of Parliament (MP) for Akwatia after the Electoral Commission declared him the winner of the December 12, 2024, election.
The Koforidua High Court granted the NDC’s request for the injunction on January 2, 2025.
The court’s ruling restrained Ernest Kumi, the Electoral Commission, and the Clerk of Parliament from proceeding with his swearing-in or recognising him as the elected MP for Akwatia.
This decision was made to allow time for the resolution of the petition filed by Yiadom.
In response to the injunction, the NPP filed an appeal at the Supreme Court, asking the court to overturn the High Court’s decision.
However, despite the ongoing case, the Electoral Commission went ahead and published Ernest Kumi’s name among the 275 incoming MPs and Parliament swore him in on January 7, 2025.
When the case was heard by the Supreme Court on Thursday, it was revealed that the NPP had failed to serve the required legal processes to the NDC, a procedural error that led to the indefinite adjournment of the case.
The NPP will now need to resolve this issue before the case can proceed.
The outcome of this case is important for the final determination of who holds the Akwatia parliamentary seat.
