Flagbearer of the Progressive People’s Party (PPP), Kofi Asamoah-Siaw, has sued the Electoral Commission (EC) for disqualifying him from the 2024 presidential race.
Mr Asamoah-Siaw and 10 others were disqualified from the contest, while 13 others, including four independent candidates, sailed through.

The EC explained that the presidential aspirants were disqualified from participating in the December 7 elections due to their failure to correct errors on their nomination forms.
In a detailed lawsuit, Mr Asamoah-Siaw argues that the EC’s decision to reject his nomination forms was arbitrary and unlawful, adding that the EC did not act fairly.
He contends that his disqualification is based on vague allegations of “errors and omissions” in the nomination forms, which the EC failed to specify.
He asserts that this violates fundamental principles of fairness enshrined in Ghana’s 1992 Constitution.
“That it is inconceivable that the same respondent who earlier identified specific errors in the applicant’s nomination forms and enabled the applicant to correct same this time round could not pinpoint which further errors there were, so the applicant could be given the opportunity to effect necessary amendment or alteration in accordance with the law,” the motion on notice further stated.
Asamoah-Siaw is praying the court for an order to quash a letter dated September 20, 2024, under the authorship of the EC Chairperson, preventing him from contesting the presidential election.
Meanwhile, the flagbearer of the People’s National Convention (PNC), Bernard Anbataayela Mornah, has also sued the EC over his disqualification from the presidential race in the upcoming December polls.
Mr. Mornah argues that his disqualification is a breach of his rights, was illegal and failed to comply with due process requirements imposed by law.
He is therefore demanding “An order of mandamus compelling the 2nd respondent to declare the 1st applicant as duly nominated to contest the 2024 public presidential elections.”
“An order restraining the 1st and 2nd respondents from printing the presidential ballot papers or carrying on with the December 7, 2024, Public Presidential Elections until 1st Applicant is declared duly nominated candidate of the 2nd applicant and allowed to contest the said elections.”
