The former COCOBOD boss Stephen Opuni has filed a motion at the court challenging the adoption of retired Justice Clemence Honyenuga’s proceedings.

Dr. Opuni, together with businessman Seidu Agongo, have been accused of causing financial loss of more than GH₵271 million to the state, and are before an Accra High Court.

It will be recalled that the judge who took over from retired Justice Honyenuga ruled that the COCOBOD trial should begin afresh to address the concerns raised by the accused persons regarding the fairness of the proceedings.

Justice Kwasi Anokye Gyimah said it would be unfair for him to adopt a proceeding that was saddled with numerous allegations, and subsequently ruled for the trial to start afresh.

But the Court of Appeal overturned the decision and asked the high court to adopt the retired judge’s proceedings.

Mr Opuni’s latest motion which is a stay of proceedings application is to halt proceedings until the issue of adoption of the retired judge’s proceedings has been determined.

Counsel for the accused, Samuel Cudjoe, informed the court of the new motion filed, adding that the return date is October 12.

However, the prosecution said they were yet to be served.

The trial judge, Justice Aboagye Tandoh, after listening to the parties adjourned the case to October 12, for the determination of the new motion.
