Kpandai MP files stay of execution against rerun order

 

Matthew Nyindam, the current Member of Parliament representing Kpandai, has presented an appeal along with a request for a stay of execution against the High Court’s ruling in Tamale, which mandated a rerun of the parliamentary election in the constituency.

The High Court had ordered that a rerun take place within 30 days due to procedural irregularities observed at the collation centre during the original election.

This ruling was in favour of the NDC candidate, Daniel Nsala Wakpal, who cited violations of electoral procedures that compromised his right to participate.

By lodging the appeals, Mr. Nyindam aims to contest the court’s decision and temporarily suspend the execution of the rerun until the appeal is resolved.

In an interview with Channel One TV on Monday, November 24, Haruna Mohammed, Deputy General Secretary of the New Patriotic Party (NPP), elaborated on the reasoning behind the stay of execution, alleging discrepancies in the High Court’s proceedings.

“Before the proceedings began, I was there along with the other lawyers. Immediately, the computer was opened, the judgment was already there. I was surprised because we had not even argued the case in court. What we saw outside was all the bigwigs of the NDC jubilating before the judgment came out,” he stated.

He further mentioned that the dispute was limited to only 41 out of 152 polling stations, yet the judge mandated a rerun for the entire constituency.

“All party agents had signed all the pink sheets, and there were no issues with the remaining polling stations aside from the 41. If anything, the rerun should only cover those polling stations,” he remarked.

Mr. Mohammed confirmed that the notice of appeal and the request for a stay of execution were submitted at 10:04 am, immediately after the court’s announcement.

The appeals process is anticipated to result in additional legal discussions, which may postpone the planned rerun and maintain the Kpandai political contest under close observation from both parties and the electorate.
