An Accra High Court has dismissed the National Democratic Congress (NDC) ‘s preliminary objection challenging its authority to hear a mandamus application filed by the New Patriotic Party (NPP).
The NPP’s application seeks to compel the Electoral Commission (EC) to re-collate parliamentary election results in four constituencies: Okaikwei Central, Ablekuma North, Tema Central, and Techiman South, citing alleged irregularities.
The NDC argued that the application was effectively an election petition disguised as a mandamus request and that declared results cannot be revisited through such a process.
However, the presiding judge ruled that the court’s jurisdiction was properly invoked for judicial review to ensure the EC complies with the law.
This decision clears the way for the substantive case to proceed.
