GBA urges rule of law in response to Chief Justice suspension

The Ghana Bar Association (GBA) has responded to the recent suspension of Chief Justice Gertrude Torkornoo, calling for a strict adherence to the constitutional processes guiding such actions.

The Association says it is monitoring the situation carefully and expects all institutions and individuals involved to follow the law.

In a press release dated April 24, 2025, the GBA confirmed it has taken note of the developments, including three petitions submitted for the Chief Justice’s removal and two legal suits currently before the Supreme Court.

The Association cited Articles 146(6) to 146(10) of the 1992 Constitution, which outline the process for removing a Chief Justice.

It involves the President, in consultation with the Council of State, forming a five-member committee to investigate the petitions and make a recommendation.

While the investigation is underway, the President is permitted to suspend the Chief Justice, and the proceedings are to be conducted privately.

The GBA acknowledged the sensitive nature of the matter and stressed the importance of fairness and discretion in all decisions made.

“It is expected that persons who play even the minutest role in this process will bear in mind Article 296 and will act in a manner that safeguards and enhances the independence and image of the Judiciary,” the statement said.

The Association also reminded the public that justice must remain accessible, impartial, and reflective of the people’s will.

It pledged to uphold its role in defending the Constitution and protecting confidence in Ghana’s justice system.
