Ga Mantse appeals to Supreme Court to quash order seeking to restore Nii Adama Latse II

Ga Mantse King Tackie Teiko Tsuru II has filed a fresh application at the Supreme Court to quash the order directed at the National House of Chiefs in Kumasi to restore Nii Tackie Adama Latse II onto the national register of chiefs as the Ga Mantse.

In a certiorari application, Nii Teiko Tsuru also wants the apex court to review and set aside the judgement of the Court of Appeal which upheld the High Court’s ruling, which first gave the order in November 2021 for Nii Adama Latse’s name to be restored in the National Register of Chiefs as Ga Mantse.

The motion filed by Professor Peter A. Atupare, counsel to the Ga Mantse, contends that Justice Frederick Tetteh of the High Court violated the principle of natural justice by failing to notify and provide a hearing for Nii Tackie Teiko before ordering the restoration of Nii Adama Latse’s name.

According to the motion, the High Court neglected to uphold Nii Tackie Teiko’s constitutional right to be heard in matters that directly impact his status and interests as Ga Mantse.

Additionally, the motion asserts that the Court of Appeal, comprising Justices Georgina Mensah-Datsa, Eric Baah, and Kwamina Baiden, made a legal error by upholding the High Court’s ruling, as the lower court lacked the proper jurisdiction to reach its conclusions.

Counsel further argues that the ruling from the High Court in Kumasi, which was supported by the Court of Appeal, violates the Wednesbury principle and leads to an illogical situation where two individuals are simultaneously recognised as Ga Mantse in the National Register of Chiefs.

The motion is set to be presented on Wednesday, July 23, this year.

Meanwhile, the National House of Chiefs in Kumasi has submitted an application seeking a stay of execution while the Court of Appeal considers their request for special leave to appeal the judgment rendered by the second-highest court at the Supreme Court.
