Collate and declare Nsawam-Adoagyiri, Ablekuma North results – Court orders EC

The High Court in Accra has ordered the Electoral Commission (EC) to collate and declare Nsawam-Adoagyiri and Ablekuma North constituencies’ parliamentary results, despite previous declarations.

This comes after six parliamentary candidates from the New Patriotic Party (NPP) filed a writ for judicial review at the High Court following the delay by the EC to declare results in their respective constituencies.

They asked the court to compel the EC to collate and declare the results.

They also asked the court to compel the IGP to ensure adequate security at collation centres to enable the commission to carry out its constitutional duties without further disruptions.

The National Democratic Congress (NDC) later sought to join the case through a motion for joinder.

However, the Court dismissed the motion, ruling that the NDC lacked sufficient grounds for inclusion.

Delivering his ruling on Friday, the presiding judge, Joseph Adu Owusu Agyeman, ordered the EC to proceed with the collation of the results in both constituencies, overruling objections from the NPP and NDC legal representatives.

The collation process in several constituencies, including Nsawam-Adoagyiri and Ablekuma North was marred by violence and unrest.

The relocation of collation activities to the Police Training School was further met with disputes over the aggregation and delegation of results.

Meanwhile, on December 19, the EC nullified the parliamentary results for Dome Kwabenya, Okaikwei Central, and Ablekuma North, citing procedural breaches and threats to its staff during the collation process.

EC Chairperson Jean Mensa outlined some irregularities that led to the decision.

“In the case of the Ablekuma North, a winner was declared without collating results from 62 polling stations.

“This is unacceptable, the declarations were made under threats and the Commission considers these as illegal. Those declarations similar in other constituencies will not be upheld,” she said.
