Former Sanitation Minister Cecilia Abena Dapaah has filed an injunction application against Special Prosecutor Kissi Agyebeng.
The injunction is to stop him from prosecuting her until the determination of the application to have her assets frozen.
The latest application, filed on Tuesday, October 10, said the former minister would suffer irreparable damage should the OSP continue with the prosecution.
“This court is enjoined to balance the economic right of the affected persons against the state’s power to fight corruption.
“It is the applicants’ considered view that they would suffer irreparable harm if the respondent [Special Prosecutor Kissi Agyebeng] is not restrained pending the final determination of the substantive matter,” the court documents stated.
They, therefore, want the court to balance her rights against the state’s power to fight corruption.
Ms Dapaah’s court hurdles began when seven persons, including her house help, were hauled before the court for stealing $1 million, €300,000, and other valuables from her residence.
The Office of the Special Prosecutor (OSP) subsequently filed a motion to freeze her bank accounts and monies recovered after searching her residence.
Aside from the funds in her accounts, US$590,000 and over GH¢2.730,000 were also recovered from her residence on July 24.
The Accra High Court is yet to decide whether Special Prosecutor Kissi Agyebeng can continue to hold Mrs Dapaah’s seized cash, which he has described as tainted.
