Former Sanitation Minister Cecilia Dapaah has filed an interlocutory injunction application against the Office of the Special Prosecutor (OSP).
She is seeking to halt the office from further confiscating any of her properties until the criminal case against her is resolved.
An application submitted by Madam Dapaah’s legal team requests the court to issue an interlocutory injunction, restraining the OSP, its officers, assigns, and servants from taking any steps that could adversely affect or prejudice her rights.
These rights include her right to a fair trial, protection from deprivation of property, and the right to administrative justice.
It will be recalled that Madam Dapaah had previously filed a similar application on October 10 in an attempt to prevent the OSP from investigating and prosecuting her and her husband, Daniel Osei Kufuor, on charges of suspected corruption and corruption-related offenses.
In her application for a judicial review in her October lawsuit, the former Minister argued that the seizure and re-freezing of bank accounts on September 5, 2023, were unfair, unreasonable, capricious, and arbitrary.
Madam Dapaah stressed that the court must approve her current application to protect her property and personal rights.
Ms Dapaah’s court hurdles began when seven persons, including her house help, were hauled before the court for stealing $1 million, €300,000, and other valuables from her residence.
The OSP subsequently filed a motion to freeze her bank accounts, and monies recovered after searching her residence.
Aside from the funds in her accounts, US$590,000 and over GH¢2.730,000 were also recovered from her residence on July 24.
The Accra High Court is yet to decide whether Special Prosecutor Kissi Agyebeng can continue to hold Mrs Dapaah’s seized cash, which he has described as tainted.
The court has scheduled Monday, November 15, 2023, to hear the matter.
