Ayawaso East: Court quashes Democracy Hub’s case against NDC

The High Court in Accra has dismissed a lawsuit brought by Democracy Hub that contested the National Democratic Congress’s (NDC) Ayawaso East parliamentary primary, determining that the case was incompetent.

Democracy Hub had initiated legal action against the National Democratic Congress, the Electoral Commission of Ghana, and the Attorney-General’s Department, aiming to prevent the EC from recognising and acting upon the NDC’s parliamentary candidate for the Ayawaso East by-election, citing that the elections were tainted by vote buying.

However, the NDC’s legal representatives submitted a preliminary objection requesting the court to dismiss the lawsuit on the basis that it was incompetent and flawed.

In his decision, Justice Agyenim-Boateng supported the preliminary objection and nullified the originating documents.

Meanwhile, the lawsuit was focused on Baba Jamal, the NDC parliamentary candidate, who faced accusations of participating in vote buying during the primaries. Mr. Jamal has repeatedly refuted these claims.

A three-member committee from the NDC investigated the allegations and produced a report that guided the party’s choice to affirm the primary results, referencing legal obligations, constitutional stipulations, and nomination timelines established by the EC.

The EC has announced that the Ayawaso East by-election will take place on Tuesday, March 3, 2026.
