Asabke Challenges Death Sentence In Adams Mahama’s Murder Case, Seeks Appeal
A former Station Master, Asabke Alangde, who was recently sentenced to death by an Accra High Court, is seeking to overturn the death sentence.
The convict, former Station Master of Bolgatanga-Kumasi Lorry Station, was recently found guilty on the charge of conspiracy to commit murder.
He, together with Gregory Afoko were on trial for their involvement in the acid attack that led to the death of the New Patriotic Party’s Upper East Regional Chairman Alhaji Adams Mahama in May 2015.
The jury had found him guilty on the charge of conspiracy but returned a 4:3 verdict of not guilty for him and co-accused, Gregory Afoko, on the charge of murder.
The court had ordered a retrial for Afoko, who also had a 4:3 verdict in his favour on the charge of conspiracy. However, that was not the case for Alangde.
Not satisfied with the verdict, Alangde’s legal team, filed a notice of appeal with the Court of Appeal urging them to set aside their client’s conviction.
Alangde’s lawyers filed the appeal notice six days after his conviction on Thursday, April 27.
The notice of appeal states that the trial judge failed to adequately direct the jury on the offence of conspiracy, which led to misdirection and Alangde’s wrongful conviction.
Additionally, the unanimous verdict reached by the jury on conspiracy and the 4-3 majority verdict against Asabke for the murder, as well as the 4-3 majority verdict on both counts of conspiracy and murder in favour of Afoko, on the same set of facts and charges, cannot be grounded in law and thus void.
Asabke is therefore seeking relief that the entire ruling/conviction of the High Court dated April 27, 2023, be set aside.
