Petitions to remove EC Chair, Special Prosecutor forwarded to Chief Justice

Minister of State for Government Communications, Felix Kwakye Ofosu, has confirmed that the petitions calling for the removal of the Electoral Commission (EC) Chairperson, her two deputies, and the Special Prosecutor have officially been submitted to the Chief Justice for action.

In an interview, Mr. Kwakye Ofosu explained that the presidency has completed its role in the process.

“Every required step has been taken. The procedure is very clear. At this point, the president’s only responsibility was to forward the petitions to the Chief Justice, and that has been done.

“The rest now lies entirely with the Chief Justice, who I trust will act in line with Ghanaian law,” he said.

President John Dramani Mahama received 10 petitions last week.

Seven of them seek the removal of EC Chairperson Jean Mensa and her deputies, Dr. Bossman Eric Asare, who heads Corporate Services, and Samuel Tettey, responsible for Operations.

The remaining three petitions call for the removal of the Special Prosecutor, Kissi Agyebeng.

Under Article 70(2) of the Constitution, the president appoints the EC Chairperson, deputies, and members based on advice from the Council of State.

Their conditions of service are equivalent to those of Justices of the superior courts, and the process for their removal follows the same procedure used for judges.

The EC Chairperson’s terms correspond to those of a Court of Appeal Justice, while the deputies share conditions similar to High Court Justices.

Mr. Kwakye Ofosu assured the public that the Chief Justice will apply the law fully and fairly in determining the next steps on the petitions.
