Supreme court grants Richard Sky’s request to amend pro- LGBTQ+ suit

The Supreme Court has granted a request by private legal practitioner Richard Dela Sky to amend his pro-LGBTQ+ suit currently before it.

On Wednesday, May 8, counsel for Richard Sky, Paa Kwesi Abaidoo, sought the court’s permission to file supplementary affidavits in support of their injunction and to amend their reliefs.

While Attorney General Godfred Yeboah Dame opposed the request for leave, lawyers of the Speaker of Parliament led by Thaddeus Sory urged that a fresh motion paper rather be filed to clean the processes.

Mr Sory suggested to the court that the applicant be given time to amend paragraphs five and seven of his applications to sync with his reliefs.

Paragraph five of the applicant’s writ is seeking “an order restraining the Speaker of Parliament and the Clerk to Parliament from presenting The Human and Sexual Values Bill, 2024 to the President of the Republic for his assent.”

Paragraph seven is also seeking “an injunction barring any attempts to enforce the provisions of The Human Sexual Rights and Family Values Bil 2024, particularly those criminalizing same-sex relationships and related advocacy efforts.”

The five-member panel chaired by Chief Justice Gertrude Torkorno upheld the suggestion and granted the request.

The court has since ordered Mr Sky to file a fresh motion paper with supporting affidavit and statement of case.

The applicant has also been given leave to address any matters of fact and issues of law in the new process.

He is expected to file the necessary processes on or before May 17.

Meanwhile, the matter has been adjourned indefinitely.
