The path has been cleared for the eagerly anticipated by-election in the Ejisu constituency.
This comes after the plaintiff, Emmanuel Gallo, withdrew the injunction application against the electoral process.
The move was aimed to halt the April 30 by-election until the lawsuit against the Electoral Commission was resolved.
It was the case of the plaintiff that Esther Osei, who filed to contest on the ticket of the party, is not a CPP member, and thus, the injunction application.
Emmanuel Gallo, the Ashanti Regional Chairman of the CPP, spearheaded the legal action, citing the party’s official decision not to participate in the by-election.
However, Gallo’s decision to withdraw the case has effectively lifted the legal barrier, allowing the by-election to proceed as planned.
His withdrawal was influenced by calls from influential figures, including former party chair and current Paramount Chief of Nandom Traditional Area, Naa Prof. Edmund N. Dele Chii VIII.
Mr Gallo stressed the need for unity and cohesion among CPP members as key factors in his decision.
In response to the withdrawal, the High Court in Accra struck out the application for an injunction against the Electoral Commission.
