Four months is enough time to put your house in order – Lawyers slam prosecution in Mfansteman MP’s case

Lawyers in the case in which eight persons are in court in connection with the murder of the late Mfansteman MP, Ekow Kwansah Hayford have lambasted prosecution for the lack of progress with the case.

According to the lawyers, four months is enough time for the prosecution to put their house in order, since the arrest of the accused persons in October.

The lawyers, who were reviving a bail application were of the opinion that the prosecution is merely feeding the court with stories.

Strengthening their case for bail, lawyers for the accused persons argued that the accused were responsible individuals in society with permanent places of abode.

They added that the accused persons have dependents who rely on them for financial assistance and have people of substance who are will to stand as sureties.

The lawyers include Paul Kumi, Kingsley Amoako, Osman Oha-de and Deh Marcellinus.

The lawyers outburst come after the prosecution, led by ASP Fuseini Yakubu, informed the court that they are still waiting for forensic examination of the evidence gathered at the crime scene of the late MPs murder.

ASP Yakubu also said the police are analysing the contacts on the phone of each accused person.

Bail application denied

Convinced by the prosecution’s argument, the Accra Circuit Court judge, Evelyn Asamoah, once again denied a bail application for eight accused persons.

The eight, who pleaded not guilty to charges of conspiracy to robbery and robbery, have been remanded.

The accused persons are Alhassan Abubakar, Naziru Fudailu Nash, popularly called SP, Alhassan Mahama Yahaya, Amadu Yakubu, Haruna Osumanu, Adam Alhassan, Fuseini Osuman and Fred Tetteh.

Prosecution’s reasons for remand

The prosecutor strongly opposed the bail application by lawyers of the accused persons.

It was the case of the prosecution that it was premature to grant the accused persons bail at this point since investigations are still ongoing.

Assistant Superintendent of Police (ASP) Fuseini Yakubu held that “considering the fact that some of the prime suspects in the case are still on the run and the nature of the case, they should be remanded.”

He also said the accused persons have not proven to the court that they have permanent places of abode as is being suggested by their lawyers

The police prosecutor, ASP Fuseini told the court at the last adjourned date that the “bullets, shells and gun” used by the perpetrators have been sent to the forensic laboratory.

The case continues on February 8, 2021.
